Scenario: Michael Jack signed a Sale and Purchase Agreement on 7 May 2008 for the purpose of purchasing a double storey terrace house in Bandar Puchong Jaya. He bought the property from Mr Richard for RM 310,000. The property is a freehold property with land area of 1,500 square feet. On 15 March 2017, he sold the property to Amanda for RM620,000. Pursuant to the purchase, Amanda was granted a housing loan of 90% on the purchase price. Jabatan Penilaian dan Perkhidmatan Harta (JPPH) Shah Alam Office assessed the market value of the property at RM 600,000. The process of transaction took approximately two (2) months to complete. Upon receiving vacant possession, Amanda started her house renovation. The renovation work costs RM50,000 were completed in December 2017. In January 2018, Amanda put up an advertisement to let the property. The respond was not good. In July 2018, she finally managed to rent it to a group of students from nearby college for RM1,500 per month for duration of 2 years. All outgoings are paid by the landlord. Amanda is responsible to prepare the Tenancy Agreement. The Tenancy Agreement between Amanda and the tenant was signed on 1 July 2018. Due to her tight business schedule, she sends the agreement for stamping two (2) months later. For documentation purposes, two (2) duplicate copies of the Sale and Purchase Agreement, three (3) duplicate copies of the Housing Loan Agreement and Four (4) duplicate copies of Tenancy Agreement were prepared. All taxes are levied by the persons liable for the taxes in accordance with the normal practice. Based on the scenario, advise on all duties payable by each of the parties i.e., the vendor, the purchaser and the tenant. Calculate all duties accrued and payable by each of the parties. For the purpose of this assignment, you are expected to; Observe all transaction activities/ instruments that are subject to taxes. Use appropriate rate, calculate all duties payable.Include in any exemptions/ relief (if any) or penalties that may applicable. | |
Format: Assignment should preferably be in Microsoft Word (can attach Microsoft Excel Worksheet). The text should be word-processed in 12-point font Times New Roman with line spacing 1.5 lines. Cover sheet should include (Contains title, Student Name, Student ID number, Subject Code, Subject Name and Semester/Year). All pages must be paginated consecutively using Arabic numerals (e.g., 1, 2, 3, etc) and printed at the bottom right of the page.
